Court Fines Muhyiddin RM1.35mil for Defamation

High Court’s Decision

KUALA LUMPUR: The High Court has ruled that Tan Sri Muhyiddin Yassin, former prime minister of Malaysia, must compensate DAP chairman Lim Guan Eng RM1.35 million following defamatory comments linked to Al-Bukhary Foundation’s tax status.

Insufficient Fact-Checking

Judicial Commissioner Roz Mawar Rozain, presiding over the case, confirmed that Lim presented a successful argument against Muhyiddin. According to Roz Mawar, Muhyiddin had ample resources to verify his claims but neglected to do so, even after Lim pointed out the errors in his statements.

Focus on Foundation’s Tax Exemption

Lim’s lawsuit related to comments made by Muhyiddin on the foundation’s tax exemption status. The judge rejected Muhyiddin’s defense, stating that his remarks could fuel racial tensions. JC Roz Mawar further noted that the remarks lacked qualified privilege as they were part of a public campaign aimed at manipulating public sentiment.

Financial Penalties Imposed

Muhyiddin was ordered to pay RM1.05 million in general damages, RM150,000 in aggravated damages, RM150,000 in exemplary damages, and RM50,000 in legal fees. Muhyiddin stated he intends to appeal the ruling, contesting both the defamation claim and the compensation amount.
