JB Magistrate’s Court Grants DNAA in Ramadan Slapping Case

JOHOR BARU DNAA Ruling Issued by Court

JOHOR BARU : A 65-year-old man accused of slapping another individual for eating in public during Ramadan has been discharged by the Magistrate’s Court, though he has not been acquitted.

Magistrate A Shaarmini issued the discharge not amounting to an acquittal (DNAA) after Deputy Public Prosecutor Nur Fatihah Mohd Nizam conveyed instructions from the Attorney General’s Chambers (AGC) to discontinue the case.

The ruling came as the court was preparing to determine the suspect’s bail.

Accused’s Plea Rejected

Earlier, Abdul Razak pleaded guilty to voluntarily causing hurt under Section 323 of the Penal Code but later disputed the case details, leading the magistrate to reject his plea.

The alleged incident took place at a shopping mall’s convenience store on Sunday (March 16) around 3.45pm, where the accused reportedly slapped a 21-year-old man.

According to the case facts, the victim sustained bruises, which were confirmed by medical personnel. However, Abdul Razak argued that he did not strike hard enough to cause visible injuries.

Social Media Outrage and Police Probe

Magistrate Shaarmini stressed that conditional guilty pleas are not accepted before setting the next mention, but the AGC’s decision resulted in a DNAA ruling.

Following the viral spread of two videos capturing the altercation, police confirmed receiving a report from the victim and are continuing their investigation under Section 323 of the Penal Code.
